In a recent federal court ruling — Kwong v. United States — the court found the IRS improperly charged certain penalties and interest during the COVID period (2020–2023). Businesses that paid late-filing or late-payment penalties, or interest on them, during those years may be able to recover some of what they paid.
It isn't automatic. A claim has to be filed with the IRS, and the filing deadline is July 10, 2026. To leave time to prepare and file, the partner handling these claims asks that you start by June 27.
