Hi Diana,
Retention requirements set a minimum:
-
3 years for payroll records under the FLSA
-
4 years for employment tax records under IRS rules
-
Longer under some state laws, such as 6 years for payroll records in New York
A single wage-and-hour complaint can reach past that minimum. Once an investigation broadens, employers produce records for more employees, locations, and time periods, often further back than their retention policy planned for.
ResNav gives organizations access to payroll and HR history beyond the minimum requirement, so an expanding investigation doesn't turn into a scramble.
How far back could your team produce records today?
Best,
Whitney
